DIAL 911 AND DIE...
Jews for the Preservation of Firearms Ownership (JPFO) has
done a comprehensive study of case law and come to the conclusion
that the police are under no obligation to protect you, the
individual citizen. In their expose, by Executive Director, Aaron
Zelman, a damning case is laid at the feet of law enforcement and
our elected government that our police force and government are
under no responsibility to protect you, the individual from harm by
criminals or the insane.
Zelman begins his article by referring back to English Common
Law, which is what U.S. law is based on. He gives the definition
of Sheriff as: "...a government employee whose main job is
enforcement of Government decisions: seizure of property, arrest of
persons wanted by the authorities, collecting taxes, etc.
Maintenance of public order, a secondary duty, was done to the
extent resources allowed."
In 1856, the U.S. Supreme Court declared that "Local law
enforcement had no duty to protect a particular person, but only a
general duty to enforce the laws." In 1982, the U.S. Court of
Appeals, Seventh Circuit, held that "There is no Constitutional
right to be protected by the State against being murdered by
criminals or madmen." Again in 1983, the District of Columbia
ruled that "The government-specifically, police forces-has no legal
duty to help any given person, even one whose life is in imminent
peril."
Linda Riss was terrorized by an ex-boyfriend. He had a
criminal record, and repeatedly threatened her. Time after time
she sought police protection. Nothing was done. A thug, hired by
her persecutor, threw lye in her face, blinding her in one eye and
permanently scarred her face. The Court of Appeals ruled Riss had
no right to protection. The Court refused to create such a right
because that would impose a crushing burden on the Government.
Judge Keating dissented, noting Riss "was victimized not only
because she had relied on police to protect her, but because she
obeyed New York laws that forbade her to own a weapon." This was
ruled on in 1968, nine years after the attack.
On September 4, 1972, Ruth Bunnell called police to say that
her estranged husband had called and said that he was coming over
to kill her. Police told her to call back only when Mr. Bunnell
arrived. 45 minutes later, he arrived and she was stabbed to
death. The California Court of Appeals held "Any claim against the
police department is barred by the provision of the California Tort
Claims Act, particularly Section 845, which states: `Neither public
entity nor a public employee is liable for failure to establish a
police department of otherwise provide police protection or, if
police protection service is provided, for failure to provide
sufficient police protection.'"
Carolyn Warren, of Washington, D.C., called police on March
16, 1975. Two intruders had smashed in the back door of her house
and attacked a female room-mate. Warren and another house mate
called police, then took refugee on a lower back roof of the
building. The police went to the front door and knocked. They got
no answer and left. The police were called again. Thinking that
they had arrived, Warren called out. The intruders found them and
for the next 14 hours the three women were held captive, raped,
robbed, beaten and forced to have sex with each other and the
intruders.
The Superior Court of the District of Columbia held that:
"The fundamental principal that a Government and it's agents are
under no general duty to provide public services, such as police
protection, to any particular individual citizen..."
The bottom line, according to Zelman, is that your life is in
your own hands. Under U.S. Law: "No individual has a right to
police protection, even when life is in clear and immediate peril."
