It's 2013, CS6, but the problem still is for me. Both paths are not compound.
When I move one path away, I can join their selected endpoints, but when i move them the way that an endpoint overlaps one of the other path, I get "To join, you must select two open endpoints". 
It's for Cmd+J as well as for Cmd+Option+Shift+J. I have no ideai how to solve it.
