By Default, the layers tab will be in the same palette as the History and Actions. However, as you can drag individual palettes from one palette box to another, it could be with any other palette, or on its own. Without an image open, try toggling the Layers menu item under Windows > Layers on and off whilst watching your screen - you should see the tab coming in and out of foucus.
