Showdown Looms Over Ergo Rule
Both the U.S. House of Representatives and Senate have passed Labor
Department funding bills for fiscal 2001 that block OSHA from issuing final
rules governing workplace ergonomics.
President Clinton will veto any legislation that stymies ergonomics
rulemaking, according to the White House. "It's clearly time to finalize
this standard," Clinton said in a statement.
The next move is for the House and Senate to reconcile differences in their
two funding bills. One difference: The Senate has voted to increase OSHA's
budget by $44 million next year-the amount requested by the Clinton
administration - while the House freezes OSHA spending at the current level
of $382 million. The dispute needs to be resolved by the end of September or
the Labor Department may be without funding come the start of the new fiscal
year on October 1.
Eyewash Enforcement
OSHA's compliance officers rarely issue citations for eyewash and shower
violations, and when they do, it's not because the water is too hot or an
eyewash facility is too far far from the worker that needs it. The major
problems identified this year are having no eyewash facility at all, or
having one that is ot operational. OSHA issued citations alleging 443
violations of 29 CFR 1910.151(c) in the first half of this fiscal year. It
classified 308 of them (70 percent) as serious violations, 120 as
other-than-serious, and 15 as willful, repeat, or failure-to-abate
violations. But the average penalty was just $825.00.
