Unless you have a modem with faulty firmware, then it's not the COM port
speed. I can get 28.8K connects using 2400 baud from the PC to the modem,
of course that's not normally a valid config! But it works! The only things
that would force the speed down is:

1)	The modem is configured to limit the connect speed.
2)	The modem at the other end is configured to limit the connect speed.
3)	The phone line is so bad it causes the modem to fall back to 14.4K.
4)	The modem at the other end has a problem talking with your modem so it
	limits connects to 14.4K. You could be trying to connect a V34 only to
	a V.Fast only or vise versa. Also USR Courier doesn't connect to a
	V.Fast at 28.8K or so I've heard. These situations will use V32bis which
	is 14.4K maximum.

Providing you are using Linux to send exactly the same INIT string to the
modem, I can't how the modem would know that you are using Linux. Maybe
the modem is equiped with the latest "telepathy" upgrade :-)

BTW, there is nothing special needed with serial ports to get 38400 operation.
If you are playing with setserial then don't. You only need to play with that
when connecting at 57600 or 115200 bps. And even then a Linux aware package
can select higher speeds without 'setserial' tricks. I have changed getty_ps
to support upto 115200 just by specifying it in the /etc/gettydefs file.
I believe that Seyon and Minicom could also be changed similarly. It's a
matter of adding
#ifdef B57600
	/* 57600 processing */
#endif
to the code to make it work.

Cheers.
