Looking at the Windows-7 licence, as opposed to the XP licence, it seem that MS wants people to believe that it not MS's problem. What the legal standing standing is is less clear to me. The first port of call is obviously the retail outlet, although I don't expect the sales staff to know anything or be authorized to do anything.
