Please Help!!
Can someone please help with advice on a problem with
Bank Of America concerning our new business account.

Problem :We started a new company in reno nevada back
in april,2001.Bank account was set up at Bank of America in reno.Banking
manager for the account contacted us out of north carolina and issued us
account and routing numbers so we get and send wire
transfers,write checks,etc.And so we did.
  We start writing checks for equipment and having
customers wire transfer funds for equipment they
were purchasing.Everthing running smoothly we think.
With in two weeks from all directions people start
calling threating us with warrants for bad checks
and no one can get thier wire transfers to get to our
account.
  Well we are going crazy trying to make sense of this.
We go to the local branch bank in georgia and they said
nothing seems to be wrong and suggested that we call
our account manager which we did to get from him nothing seems to be
wrong.Almost 2 weeks go buy.
  Buy this time suppliers and customers think we have
robbed them.To make a long story short we get a call
from our account manager at a wachovia bank telling us
we have the wrong routing numbers on our checks that we deposited there and
they wanted to file fraud charges. TheY tell us the account is in Nevada but
routing to N.C. We were stunned.
  After making sure that it was not our mistake we contact our account
manager which agreed he had screwed up.He says i'm sorry hope this has not
caused you any
problems.Will did he get an ear full.After a long hard
conversation he agrees to write a letter stating that it was the banks
mistake and that he was going to work
with us to get this mess taken care of.He did type a letter and faxed it to
most of our suppliers and customers which calmed most of them. They wont
give our attorney a contact for their legal dept. They wont even talk to us.
  This little mistake has gotten us in the hole close
to $100,000.00 and still going up.After leading us to
believe they were going to work with us to get out of
this financial crisis they put us in said today it's
not our problem.We feel no responsablity for this.
  I find it hard to belive that we have to loose everything and possibly go
to prison because of a banks
mistake. We are told the fbi is investigating this and we are not running we
intend to make good all our customers purchases but this is way out of hand,
the bank wont even give us a legal dept to contact or any discussion of
settlement.
we openened an account with Bank of america, they gave us incorrect
routing numbers and account numbers. We  did not catch the problem
until 4 weeks after the account was open. This caused us to have 21
checks returned to customers and 4 wires to us rerouted to we dont
know where. we lost $31000, and 7 weeks and still going of our time,
not alone the disgrace this has put us in. they wont give us a legal
dept or any type contact. they admitted in writing it was their
mistake but wont talk a settlement for our loss. We look like two big
crooks out here and they wont pay for anything. We lost our business,
many many customers,vendors, and now face charges and being sued for
their mistake. we have been to many lawyers and have been threatened
with charges, suits and bodilly harm. We are standing behind our word
with our customers but we need help, I gave my last $4000.00 to a
customer as a refund and we are out of money of our own to give please
help.    We have been told in writing Bnak of America assumes
responsibility, We have been told there is no legal dept contact. We have
had our account numbers changed without permission, We have had our account
access been numbers cancelled and renewed, We have had our account shifted
from branch to branch and told we dont have a branch. They wired funds
without our signature or permission. They lost our records twice and made up
new records and used a fax for a signature card to authorize payments. They
refused to settle our losses.
Now we
finaly found a lawyer we thought would help, so we went to the lawyer
John
Hessmer that took a $5000.00 retainer and has done nothing. So we
asked for
it back minus any fees which were only one meeting. He will not even
talk
about the money refund. He has avoided our calls and will not return
the
money. I am flat broke now. I have been giving my customers all my
money and
we still have three more to settle with. We just need some time, we
have
banks and vendors and customers coming at us and are facing legal as
well as
crimminal prosecution. The Bank told me they dont see how they owe us
any
thing. I guess 6 weeks and still going of no work except to refund
customers, and lost time, not to say the humiliation and respect we
lost, is
not worth anything. In returns do to this problem alone we have
$18,350 in
freight and loading charges. We dont understand how they can say they
did
what they could and dont owe anything. Diverting and routing someones
funds
incorrectly and giving the wrong routing numbers is a big mistake. Now
we
are paying, We need some type of legal protection from being sued and
prosecuted so we can get our customers paid or settled.
If we are not allowed to work this through they will also be at a
great loss
and out their funds. We need help please.
