Bush in the case of Bush v. Gore, thus = removing the final roadblock in his bid to become the 43rd President of = the United States of America. But the nation still had to wait nearly 24 = hours before Al Gore would concede (this added to the five-week delay = Gore's legal maneuvering had already caused because of his = win-at-any-cost attitude), which he finally did Wednesday night, at 9:00 = p.m. EST, on national television. President-elect Bush followed at 10:00 = p.m., addressing the nation from the Texas Legislature. Perhaps the = strangest presidential election this country has ever experienced is now = behind us, and NRA members and the pro-gun community can breath a brief = sigh of relief with the knowledge that the Clinton-Gore = Administration-the most anti-gun administration this country has ever = seen-will come to an end on January 20, 2001, Inauguration Day.=20 While our victories illustrate what we can accomplish working together, = we cannot afford to become complacent! Unfortunately, there are still = many lawmakers in Congress and state legislatures who will pursue their = gun-ban crusade, and we must stand ready to turn back their efforts at = every turn. Similarly, we must be poised and ready to take advantage of = any and all opportunities to further strengthen our freedom! The margins = in both houses of Congress are extremely thin, and we must now re-double = our efforts to ensure that our victories at the ballot box translate = into victories in the legislative arena. Rest assured we will keep you = posted on all related developments in future Alerts.=20 YET ANOTHER RECKLESS LAWSUIT SUFFERS DEFEAT U.S. District Judge Jerome B. Simandle dismissed Camden County's (N.J.) = reckless lawsuit against 11 gun manufacturers last week, stating the = county failed to state "legally actionable claims." Camden's suit = claimed that a total of 21 gun manufacturers-all of which are subject to = strict federal, state, and local laws regulating the production and = distribution of their products-should be held financially accountable = for the criminal misuse of firearms. The suit alleged the gun makers = were negligent in the marketing and distribution of firearms, and that = gun makers created a public nuisance. Judge Simandle, however, found the = county's suit "lacks constitutional standing," and that the 11 = manufacturers "may not be held liable for creating or maintaining the = public nuisance of which Camden County complains." Ten of the companies = named in the suit did not join in the motion to dismiss the lawsuit, and = remain, for the time being, as defendants. Camden County Counsel Robert = G. Millensky stated the county Board of Freeholders will consider = appealing this decision.=20 S&W JUST DOESN'T GET IT When Smith & Wesson (S&W) signed an agreement with gun-ban extremists = within the federal government last March-an agreement often referred to = as the S&W Sellout (Special FAX Alert, 3/20/00)-it was spurned with = virtual unanimity by the firearms industry, the pro-Second Amendment = community, and consumers. NRA-ILA Executive Director James Jay Baker = decried the Sellout as "a futile act of craven self interest," and gun = owners responded by refusing to purchase S&W products, leaving the = company teetering on the precipice of financial disaster. Later in the = year, S&W CEO Ed Schultz-one of the primary architects of the = Sellout-was removed from his position, and speculation began that S&W = might soon change its corporate policy.=20 Unfortunately, it appears that S&W has not learned its lesson. The = company recently entered into a new agreement with anti-gun politicians, = this time with the city of Boston, that is almost identical to the = original. In the places it differs, however, it is actually worse.=20 For instance, the new agreement sets more complicated standards for a = mandatory second serial number, and it is also more stringent in its = requirement that S&W commit revenue to "smart" gun research. Both of = these features of the "Boston Sellout" are likely to result in added = costs that will be passed on to those consumers who have not yet = abandoned S&W, but may do so when they learn it is they who will be left = shouldering the financial burden of propping up a company struggling = with failing sales. Perhaps most troubling, however, is that this latest = capitulation to the gun-ban movement requires a "compliance liaison" = from S&W to consult with the city on manufacturing compliance issues. In = other words, politicians who wish to ban firearms will have a direct = hand in how those firearms are designed and manufactured.=20 Obviously, the leadership change at S&W has not brought any new ideas to = the company, and, in fact, may have exacerbated them. It continues to = take action detrimental not only to itself, but to gun owners and the = gun industry at large. It is sad to see a once proud gun company and = industry leader following such a misguided path, but perhaps it will = realize its error before doing any more harm to gun owners, or = irreparable harm to itself.=20 -------------------------------------------------------------------------= ------- Having difficulty finding ILA-related info?
