Reference: Page 9 of the "Lapses of > Consciousness Consolidation Table." If correct (and I can't decipher the meaning table -- the search function of my copy of Acrobat was disfunctional, and the first few pages seemed to make sense), then the regulations are not consistent with the law. Section 2806(b) mentions sleep apnea; by section 2806(a) defines "Disorders characterized by lapses of consciousness", and "sleep apnea" only falls into that category if it "may" cause "lapses of consciousness" as defined by 2806(a). The logical interpretation of the law is to redefine "sleep apnea", for the purpose of the law, to mean "sleep apnea as characterized by lapses of consciousness as define by 2806(a)", which is a different diagnosis. Furthermore, if the DMV is interpreting the regulations in the incorrect way that you say they are, they may be subject to ADA violations -- some of the diseases named in the regulations do not, in fact, fall under the law, so ADA should apply. I smell a class action (or RICO) suit against the California DMV. Any takers? -- Arthur L. Rubin 216-5888@mcimail.com
