People not infrequently read things into ADA that aren't there. 

It has already been to ruled by the Supreme Court that it's legal to
pull a CDL from a driver with uncontrolled BP.... just on the
supposition that he's a heart attack waiting to happen.

I smell "if somebody pushes it into the courts, they end out going
from a disliked standard to one they like even less." Look at the
cases the Supremes have been through interpreting the ADA.
