The law can only be read properly if "sleep apnea" is defined as the medical diagonosis of "sleep apnea" & a separate diagnosis that it meets 2806(a) -- otherwise the regulations are not consistent with the law. I'm not saying the result set by the courts would be any better, just the regulations appear inconsistent with the law, and any court which takes the case would probably find some way to conform them.
