WESSINGER: "A Munroe Falls man is trying to clear his name tonight
(anchor) concerning charges he disseminated child pornography
through his computer system. As News Channel 5's Ross
Kirgiss reports, the man says he's a victim of the
system, and wants to set the record straight."
KIRGISS: "22-year old computer whiz Mark Lehrer ran a computer
(reporter) bulletin-board from his Munroe Falls home until a year ago,
when police said he used it to disseminate child pornography.
Through Mark, people called in to access programs and ideas,
and there was also an adults' only file with strictly
controlled access. It contained similar pictures to
what News Channel 5 showed you in a series called "Dirty
Data". Yet some of these pictures mistakenly slipped into
files that could be accessed by anyone."
LEHRER: "I don't know how it happened. I didn't know that it happened
(sysop) until after the arrest in fact."
KIRGISS: "Yet someone complained that children were gaining access to
(reporter) that controlled file, so on the advice of prosecutors, Munroe
Falls police found a 15-year old child, had him sit
down, log into the system and download the controlled
file. That led police to search Lehrer's house, taking
his $3,000 computer, only to have the charges thrown out
for lack of evidence later on. So prosecutors then found
computer disks in the Lehrers' home, which they said
contained child pornography. Mark says he didn't realize
it, but someone mailed him the files, and because he had
them in his possession, he finally agreed to a
plea-bargain for a misdemeanor of attempting to possess
criminal tools. Yet today he feels singled out."
LEHRER: "And then they got me indicted on child pornography with five
(sysop) pictures that are available on public systems all across the
country, even in Ohio."
STAHL: "My response is no, we had a complaint from a citizen; we
(police investigated that complaint the same as we would investigate
chief) any other complaint."
KIRGISS: "Mark says his example shows some computer operators who
(reporter) take mail can be victims, and computer buffs should take
note."
LEHRER: "You don't know what's going to be coming on your system, okay,
(sysop) and even if you're careful about it, there's going to be
people sending stuff that some other people might construe as,
y'know, like, look what happened to me."
KIRGISS: "In Munroe Falls, Ross Kirgiss, News Channel 5."
