Don't sign if you don't > understand the contract. Get legal advice if you have any questions. where do the homeowners "sign" for this "contract" you refer to..... show me one set of ccr's that requires homeowners to sign and initial every page and to sign that they have read and understood what they have just signed - that includes all applicable civil and corporate codes. doesn't appear that you comprehend what you read. there is often no requirement that homeowners SIGN the hoa "contract" you refer to. sometimes this so called contract just appears in the mail weeks later. it can change before you have even had a chance to move in. but more than anything, there is no guarantee in this "contract" that the "elected" board of neighbors will follow the law. and if they don't follow the law, they are backed by multi millions of dollars in D&O liability insurance paid for by the homeowners. some contract. so you advise prospective hoa homebuyers to get legal advice? why the hell do homeowners need legal advice before buying into an hoa. are there problems there? of course there are. actually, that is great advice. WARNING to homebuyers, before you buy into anything that even closely resembles an association like condos, gated communities, retirement villages, or anything where the street entrance to the neighborhood changes suddenly from concrete city streets to cheap asphalt, etc......demand a copy of every page of the current ccr's, all recorded amendments, the applicable civil and corporate code, the rules by laws and regulations, two years worth of minutes of meetings, five years worth of financials, take it all to a lawyer, have them review it (this will take hours and will cost you a lot of money) and THEN, ask the lawyer if they think it is a good idea to buy into a homeowners association. ask the lawyer if there is any risk involved. ask the lawyer what happens if you lose your job, can't work, and can't afford that $300 per month hoa dues. ask if the hoa can fine, assess, lien and foreclose on your home without your day in court....ask ask ask... one thing for sure - in hard times you would be better off to pay those dues before you pay your mortgage because the hoa may be allowed to non-judicially foreclose on your home long before the bank can. sometimes in as little as 90 days. have fun in hoa life!!
