While I agree with you, let me make some observations:

1. Why did you include the entire original posting and stick your comments
   at the bottom?  You aren't going to find many allies this way.

2. The proper way to complain about this kind of thing is to complain
   to the administrator at the user's site.  Netcom is particularly
   sensitive about this kind of thing.  If you send the contents of the
   article to postmaster@netcom.com, they are going to look into it because
   they don't want any troublemakers.

3. You want to stop him - compete with him.  From the description of
   the software, it isn't that big a deal.  I wrote such a program
   years ago (and have since lost it), and there are commercial
   products that do this.  Oh, I'm sure it has a special feature or
   two that makes it better for some specific situations, but I'd
   wager that it's not something I'd be able to make heavy use of.
