Probably has validity where both/all involved parties are in the U.S. 
If one or more parties are in other countries that opens a really
interesting question about whether or not U.S. law or even U.S. courts
would have any jurisdiction.  And if not...who would?  

I think there are still a lot of unanswered questions and some
interesting issues to be dealt with.
