I don't think so and agree > with you. ;-) Actually, it has to do with copyright law, not with the far more sane consideration of helping a neighbor. In copyright law I've read, I don't recall any consideration for level of support or degree of maintenance. I'm not going to say it's "piracy" because that is propaganda talk. I will say it is unauthorized duplication and distribution, and in most countries it is illegal; points I'm surprised more of the old NeXT users aren't chiming in to note as they have in the past.
