The license for QDOS, which was produced by a Seattle company and ran on early (non-IBM) 8086-based systems, was purchased by MicroSoft. While QDOS had some similarities to CP/M, it was not the same code. Yes, DOS has several command names in common with CP/M; but so did VMS on DEC Vaxen. Yes, parts of the software interrupt and BIOS structure were similar, but the standards were widely published, and I'd guess the intent was to make life easier for those developing DOS applications.
