You are correct to the letter, but not to the spirit. Microsoft and the US
Govornment did sign an agreement to stop this practice. The courts after
some fiddling among themselves agreed to it. 

Given all of BG's other practices, I doubt that he signed such an
agreement out of the goodness of his heart. The govornment had MS on this
point if nothing else. The only reason why there wasn't a verdict was so
that MS could hide behind such empty words as below. MS has a long record
of going to the mat when it benefits them. Sometimes you win when you fall
down. This was one of them.

Companies play this game all the time. It just gives them a legal shield
to hide behind. 

Furthermore, this is no more a misrepresentation than 9 out of 10 computer
adds you find in any magizine. But I will accept your correction to the
letter.
