Absolutely, though if the hypothetical subject were also tailgating I would not be pleased. In this country, in this state at least (Wisconsin--and most others), the left lane is for passing only. Unless you're passing someone that situation shouldn't even occur, and the faster car has right of way--though the slower car obviously does not have to vacate the passing lane until it is safe to do so, by which time the pass will probably have been completed anyway.
