Intent has a lot to do with it. A good example is "grab bags" at sports card shows. Dealers seal in envelopes or brown bags sports cards. They ask for $1 per bag (or whatever) and guarantee that there is at least $1 worth of cards in the bag (according to an accepted price guide). They also have advertisded "Find the David Robinson Rookie Card, a $5 gift certificate, ec..etc.". This is considered an illegal lottery in many states. The card show runners and grab-bag advocates say that it is not a lottery because the "consideration" element of the lottery doesn't exist... i.e. when the buyer buys a grab bag for a $1, he is getting at least $1 worth of goods. I know that the Attorney General's office of California has stated that despite this, the intent of the buyer is different which means that there is "consideration" and thus it's a lottery. If you apply this to the current scheme^H^H^H^H^H^Hscenario, are people REALLY into this for buying this recipes? -ben
