UN Human Rights Committee -- Process These Complaints!

To All:

Once again, I ask the help of all persons of good will in securing, at long
last, recognition and processing of my human rights complaints against
Denmark and the Netherlands.

All this week, the Working Group of the UN Human Rights Committee has been
meeting in Geneva, determining the agenda for the Committee's 69th session,
which will run from 10 July to 28 July. I have sent the following letter:

----------------------------------------------------------------------------

Extremely Urgent!

76 Market Street, Apt. D5
Perth Amboy, NJ 08861-4445
United States of America
23 June, 2000

Working Group
Human Rights Committee
Office of the High Commissioner for Human Rights
Palais des Nations
1211 Geneva 10
Switzerland

Subject: Unacknowledged, unprocessed, unresolved complaints. Situation
desperate. Call a halt.

Dear Working Group:

I enclose my letter to your New York office dated 7 March, 2000. Its
Certified Mail Return Receipt, No. Z 159 856 129, never came back to me.

I enclose also my letter dated 21 April, 2000 to the Office of the High
Commissioner. Its mailing label was EWO18778921US. Like its many
predecessors, it has prompted no acknowledgment, response, or action.

On 4 November, 1991, I mailed, from Allerd, Denmark, a complaint against
Denmark to the Human Rights Committee. My communication of 9 March, 1996,
mailed from the United States, restated, reaffirmed and updated this
complaint.

On 11 March, 1996, I mailed, from the United States, a complaint against the
Netherlands to the Human Rights Committee.

A new copy of the 1991 complaint against Denmark was included with my letter
of 21 April, 2000 to UNHCHR, along with a new, signed original of its
follow-up and a new, signed original of the 1996 complaint against the
Netherlands. I can supply these again on request. These and other texts are
available on my web site at
http://www.angelfire.com/nj/jhgraf/otherint.html, including my "Summary of
JH Graf's Contacts with United Nations."

I have not been able to obtain any information regarding the reception,
admissibility, or processing of these communications.

An international conspiracy appears to have obstructed justice in these
matters. Having attempted three times to escape from the United States of
America, having been three times subjected to coerced repatriation, I am a
hostage in my own land. The interference with my basic rights is so severe
that I am held in what amounts to incommunicado isolation. My communications
either fail to reach their intended recipients or are corruptly ignored. I
am a "non person," with whom nobody will cooperate, for whom nobody will
advocate.

I am an unacknowledged "prisoner of conscience" in the USA, "confined to a
village" by malicious bio-chemical attacks upon my physical health and
deliberate withholding of appropriate, effective medical treatment. My
health is very poor. I cannot now travel out of my community, nor can I care
for my home and myself sufficiently well to preserve my dignity. There is
no-one to help me.

I request -- I insist -- that the Human Rights Committee take up these
matters at its 69th Session, which begins 10 July, 2000. Process my
complaints expeditiously and call a halt, requiring Denmark and the
Netherlands to rescue me from the hell into which they thrust me in flagrant
violation of international law.

I had a quick look at your website; you must feel pretty unsafe if all that
happened to you. But I think you must sort it out in your own country. Sue
them; go to court. Wish you well.
ps. answer via n.g. please.

easy rider:

I should have mentioned above that the story of my European ordeal is told
in "Hard Realities" http://www.angelfire.com/nj/jhgraf/hardreal.html on my
web site.

Thank you for your good wishes, but no solution is possible in this country
(see "A Nation in Denial" on my web site at
http://www.angelfire.com/nj/jhgraf/anid.html). As indicated in my letter to
the UN Human Rights Committee (the most recent of many, many such
communications) I am suffering terribly here, utterly unable to obtain
effective advocacy or the equal protection of the law. I am a "non-person"
whom nobody will represent, with whom nobody will cooperate. It has been
that way for many years.

A person subjected in his own country to persecution, state terrorism, and
mental torture has a right to LEAVE his country. Since a history of
persecution validates a fear of persecution, the individual has a right to
seek asylum in other lands. If those other lands have ratified the
International Covenant on Civil and Political Rights and its Optional
Protocol, the asylum-seeker has a right to expect fair and
non-discriminatory consideration of his application. If not treated fairly,
if subjected to the human rights CRIME of forced repatriation, he has (if he
is lucky enough to survive) the right to pursue a UN complaint against the
host country that has committed these human rights offenses.

Is there any reason why the UN Human Rights Committee should NOT process --
or even acknowledge -- my complaints? Is there any reason why human rights
advocates should not prevail upon that body to do so, after all these years?

What about newspapers? Maybe you should go to a not"western" country. But I
hope you get a positive response from HRC. If so where would you like to
live.

Newspapers ignore me. Everybody who doesn't insult me either ignores me or
patronizes me. My congressman, Robert Mendendez (Democrat of New Jersey)
grew up in the same city where I grew up, went to school with my niece's
husband, was my sister's boss when he was Mayor of Union City and she worked
in the Tax Assessor's Office, still calls my sister by her first name, but
he will not answer any letter dealing with my personal situation. There is
no hope for me here. The years of horrendous painful frustration stretch far
into the past, and the future, given current trends, may be very short.

My ancestors came from Northwest Europe and the British Isles. I have roots
there. I feel at home there. Many of my ancestors came from the part of
Germany that lies between the Netherlands and Denmark. Some were probably
Danish subjects.

Though it does not bear, strictly speaking, on my asylum applications, I
have made the point that I sought refuge from persecution -- very real
persecution -- in Europe, the continent that saw the births and holds the
bones of my ancestors. I feel that I have a right to live in a free,
democratic land whose laws will protect my rights and respect my dignity --
a land where my cherished ideals will not be subject to ridicule or
suspicion, a land where I can feel at home and be reasonably secure. I have
a right to live and be happy and make the contribution -- the "wacko
liberal" humanitarian contribution -- that I still have it in me to make.

My first choice for asylum was, and still is, the Netherlands. I was
healthy in the Netherlands, apparently because there were things (radiation
and bio-chemical poisoning) that the Dutch wouldn't allow the stinking,
sleazy American bastards to do to me.

Another wonderful fact is that people in that FREE country can medicate
themselves with marijuana without getting arrested. During the blessed
months that I spent in Rijsbergen, I found that substance to be a superb
mood elevator, a pain suppressor, and a fantastic shield against the verbal
attacks of "Marlin Fitzwater's private purgatories" (see Message 51.1
http://forums.delphi.com/n/main.asp?webtag=jhgraf&msg=51.1 on JH Graf's
Human Rights Forum). Since my former employers (the New York State Office of
Mental Retardation and Developmental Disabilities) had tried to "set me up"
for disciplinary charges by apparently planting marijuana in my car (and
maybe my home), then retrieving it via illegal searches, I thought of
mentioning America's insane marijuana laws in my asylum applications, but I
decided that my case was strong enough without it. By the way, I have never
been charged with, or convicted of, any crime in any state or nation.

While at the Dutch camp in Rijsbergen, I was able to work out twice a week
with gym equipment and walk great distances (by my standards, at least). I
was happier than at any time in the last fifteen years, and I was getting
stronger every day. I can still remember walking around Breda, passing
pleasant people on the street, interacting warmly with people in stores,
basking in a civilization of civility and respect, seeing not one American
face, not one American flag. I swear I could be happy without ever seeing
that flag again.

A country that, for reasons of rank discrimination, takes in people who have
no respect for its culture and traditions, ought to welcome a human rights
defender like me. Something is very wrong with a Europe that excludes
persons who love it and believe in it as I do. Something is terribly wrong.
