In ne.general Charles M. Kozierok <ixlu@pcguide.com> wrote: > Article I, Section 3: > " 3. The distinction I see is the clause "when elected" which is in the senatorial part, but not in article 2, section 1, clause 3, about electing a president and veep, nor is it in Amendment 12. That's a very subtle distinction, I admit. In Judaism, we might call that sort of distinction "pilpul" -- "hairsplitting" -- however, such hairsplitting is important, and just because a distinction is subtle doesn't mean that it's not significant. The requirements for senator state that someone must be an inhabitant *when elected.* The requirements for getting electoral votes from a state are that either the prez or the veep candidate is not an inhabitant. Not "is not an inhabitant at the time of election." Subtle? Yes. Significant? I don't know; I'm not qualified to make that judgement. Personally, I think it is, but I'm hardly a constitutional scholar. - Ian -- Marriage, n: The state or condition of a community consisting of a master, a mistress, and two slaves, making, in all, two. -- Ambrose Bierce SSBB Diplomatic Corps; Boston, Massachusetts
