Bush is eroding the Rights of the Disabled

Preserve the Rights of the Disabled

The Americans with Disabilities Act was passed by Congress in 1990
with overwhelming bipartisan support, and signed into law by President
Bush and the evidence of its success is everywhere. Handicap parking
spaces, Braille instructions on ATM's, and ramps built into sidewalks
have all become commonplace fixtures that make an enormous difference
in the lives of persons with disabilities. Yet, despite ample evidence
that the ADA is working, some Members of Congress are trying to place
new roadblocks to justice for people with disabilities.

A bill called the "ADA Notification Act" (HR 728) was introduced by
Rep Mark Foley (R-FL) to punish individuals for bringing timely
lawsuits to enforce the ADA. Legislation of this nature would punish
individuals who do not first notify a business of an ADA violation and
then wait nearly three months before filing a lawsuit - even if the
business has been breaking the law for years!

Take Action! Urge your members of Congress to oppose this legislation.

* The ADA has been in effect for 14 years. Businesses that have spent
the past decade breaking the law should not be rewarded.
Supporters of this bill claim that it would ensure that businesses are
given adequate notice. In reality, the ADA included several safeguards
to ensure that businesses and other public accommodations would have
adequate notice of their obligations and ample time to take steps to
bring themselves into compliance. Businesses have had a full decade to
become ADA compliant, and there is no reason for further delay.

* There is ample information and training available for businesses to
determine if they are in compliance.
Each year for the last seven years, the U.S. Justice Department has
notified more than 6 million businesses of their responsibilities
under ADA and how to comply. The Justice Department also runs a
toll-free ADA information line, which receives more than 100,000 calls
a year. Given that materials are prepared for a wide array of business
and specifically for small businesses, there is no reason that a
business cannot determine if they are ADA compliant well before a
lawsuit is filed.

* Three months is too long for someone who needs an accommodation
today.
Persons with disabilities should be able to engage in such basic
activities as work, travel and obtaining healthcare without worrying
about which businesses are complying with the ADA and which ones are
breaking the law. Persons with disabilities have had to travel from
hotel to hotel to find one that is wheelchair accessible, have had to
demand that their guide dogs be allowed into restaurants, and have had
to risk losing their professional accreditation when mandatory
education classes were not sign-language interpreted.

* Claims of frivolous lawsuits are already handled in current law.
The bill's supporters claim that the legislation would cut down on
frivolous lawsuits. But frivolous lawsuits are already prohibited by
law and such claims are regularly handled by courts and state bar
associations. Courts already fine law firms and plaintiffs when they
find that a lawsuit is frivolous.

TAKE ACTION!

I visited the website and submitted a well modified fax to my reps.

What really got me annoyed was at the end of the process, each rep required
that the topic of the fax be listed according to a list that they provide.

Guess what topic was missing?

<play Jeopardy theme song>

No, you do not have to be Ken Jennings to get this one correct!

See below...

Correct, Handicapped rights is the missing category!

No, you do not win $2.5 million. I told you that you do not have to be Ken
Jennings to get that one right.

Please visit the ACLU website and complete the fax and see if your
representatives do the same thing. If so, email them with a complaint, like
I just did.

If they are not thinking that this is a separate issue that crosses all
ethnic, political, religious, age, etc. groups, then they are not ever going
to "get it" until it happens to them.

While you have their attention, suggest that they spend a week in a
wheelchair, or with a blindfold, or with earplugs, or all three, etc. for
more of an education.

I selected the category as "Judiciary" and got their response:

"As you know, H.R. 728, introduced by Rep. Foley (R-FL), would amend
the Americans with Disabilities Act of 1990 to require an opportunity
to correct alleged violations before a civil action could commence.
This bill is currently under consideration by the House Committee on
the Judiciary. "

Don't you have Judiciary?

I do not want Disability Issues relegated to Judiciary, or any other
category, since they cross so many issues and groups.

You got an automated reply. Not acceptable.

Really? That category list sucks. Did you get them to add "Disability
Issues" to the list? I'm pretty awkward with their system, and I'm
sure others having same problem so thats why its not on the list <g>.
Maybe going back to old fashioned way like writing letter would help?
I hate to use up my .37 stamps <g>.

The rights of the disabled are being eroded by a handful of criminals
and their attorneys who have managed to use the ADA as a device to extort
money from honest businesses.
The ADA has also meant billions of dollars being spent on buildings and
modifications which are of use only to a tiny minority of society. Remember
that the ADA was passed with the promise that it would provide greater
access to the disabled. While this goal has been accomplished to a great
extent, the great majority of the money devoted to these purposes has gone
to the bureaucracy and their cronies who benefit from the required
improvements.
While the ADA is very valuable to those who really need it, it is a dead
issue because of the abuses of a few greedy people. It represents
corruption and excess. The ADA is going away and you aren't going to win
this one. It isn't Bush's fault so look to your own.

The "wonderful" thing about disability is that you are only a nanosecond
away from your own.

Ask Chris Reeves.

How do you know that there have been no complaints?

Perhaps no one complained because they could not get inside to complain.
Spend a week in a wheelchair and see if you do not find something to
complain about.

Why do you advocate for a complaint driven society?

Are you in favor of abolishing ADA and giving businesses free leeway
to discrimination practices? Are you in favor of businesses who
practice discrimination?

"Tiny" minority? How tiny is tiny? It's the disabled who benefit from
the required improvements.

What if *you* became disabled due to accident or disease? What if you
became deaf instantly the next morning for no reason? Without ADA,
you'll be denied rights to equal accessibility and you'll be blaming
yourself for saying this here.

Furthermore, has Bush done anything to help the disabled? Nope. Has he
reinstated Clinton's executive order to order Fed govt to hire 100k
disabled? Nope.

Unnecessary? Is it unnecessary for you but not for them?

If everyone is able to get hired instantly, yet you're telling the
disabled to wait 3 months? Is that equal accessibility? NO!

If someone has been "violating

Maybe? How would you know? Maybe people are complaining but EEOC is
not helping because they're too incompetent? Maybe lawyers' fees are
too high for them? You're jumping into conclusion too soon.

best tactic is to await their entry in the realm of disability, and then
watch them whine.

Now you raise a strawman. We are not disucssing able bodied. We are

That is quite obvious. However, not all complaints are created equal.

The inability to get into a government officbuilding or courthouse, the
inability of a person to provide their medical history because they use sign
language, the inability of a person to cross the road because the crosswalks
are not audiblized is not a lack of a bed of roses are not inconveninnces.
They are the inability due to barriers of a person to do things that you

The fact that you are sick of it is just a sad commentary on your lack of
intestinal fortitude. As for this being perfectly reasonable, I would assume
that you would think the same when you have a need. Like the old saying
goes, a conservative is a liberal who has been mugged.

Wow, that speak volume about yourself as an insensitive jerk!

You're complaining about disabled people getting "unnecessary"
reasonable accommodations that are necessary for them to be able to do
the job to support themselves for a living like you and enjoy life.
You would rather have them thrown out into the sea. You're really one
sick bastard.

I'll tell you what. Chop off both your legs and when you come back
here in one year, you will realize you were being such an insensitive
jerk! Nobody will care about you and you'll be sobbing and whining
everyday for sure!

Just remember that disability can be just a nanosecond away. Ask Chris

Can be anything. Like plane crashing onto you and you survived. Or a
botched robbery into your home that left you crippled. Or a freak car
crash. Freak things can happen. You can become deaf the next morning
for no reason. This happened.

No one is immuned from becoming disabled.

One has to get off his high horse and stop looking down those who are
less fortunate. This person can be next. Noone is immortal forever.

There's some Zen wisdom there:

"Immortality is temporary."

This is Clinton's fault. I'm tired of having to pay triple taxes so
they can fit buses with 6 feet wide seats so some FATASS CAN SIT.
Earth to obese person: lose weight if you want to take the bus. Why
can't terrorist loving, anti-American disabled people just learn to
SHUT THE FUCK UP like our mute friends!!!!!!!!!!!!!!!!!!!!

Didn't Jesus say that disabled people should die. Something like "If
thou arth special, the offeth thyself and stoppeth wasting valuable
oxygen."

This is Clinton's fault. I'm tired of having to pay triple taxes so
they can fit buses with 6 feet wide seats so some FATASS CAN SIT.

--For people with an anus as big as yours, they need those seats, too.

Something like "If
thou arth special, the offeth thyself and stoppeth wasting valuable
oxygen."

Thanks for the Canadian perspective. As for your knowledge of
Christianity...well....

So for those soldiers returning from Iraq blowned up by bombs now
disabled... are they now terrorist loving, anti-American disabled
people?

Isn't there one of those commandments that says "Thou shalt love thy
neighbour as thyself"?

Your hatred is so astounding!

You've been reading too much MAD magazines. And Bush has succeeded in
brainwashing you to death with those terrors....

Go seek psychological help, my friend....
