I am an attorney with a patent firm in Minneapolis, Minn. I'm currently exploring the idea of writing another law review article, generally on the topic of best mode (a patent law construct) in the context of computer software patents. Unfortunately, my professional and personal priorities do not permit me to dedicate the amount of time I would like to this project. Therefore, I'm looking for a law student who has sufficient time to assist me with this project. You would be given second author status. The ideal candidate would be a second or third year law student who is planning a career in patent law, who has good writing and research (i.e., law review-type) skills, and who has a computer software background. However, I am open to consideration of any interested candidates. Your primary responsibilities would be to conduct extensive research on this area of patent law, and also write at least one section of the article. My time line is to finish the article around the Spring of 1999. If your school permits, I could function as an advisor for a for-credit independent research project/course in conjunction with this paper. If you are interested, please email me at mdryja1@uswest.net, or dryja@slwk.com. My firm's web site is at http://www.slwk.com. Thank you!! - Mike.

Perhaps we could start a discussion on best mode here. . . Suppose I have a semiconductor invention and have an enabling disclosure for my novel microcircuit. However my enabling disclosure is for Aluminium conductors whereas the best mode I contemplate uses Copper conductors. However I do not have the time, money nor design tools to produce an _enabling_ disclosure for copper, even though I have certainly contemplated doing it. Am I in a catch-22?

My view of 112 p 1 is that you need to disclose:
1) your best mode
2) an enabling disclosure of a mode
3) a written description of what you consider to be your invention.
On the surface this means that the best mode need not be
enabled. However, I do not know your technology that well,
but my impression of it is that there is a bit of a jump
between aluminium and copper. In particular, aren't there
some problems with copper that are just now being solved?
I seem to remember some media interest in an announcement
by IBM concerning copper this year, and seem to remember
that the problem was that copper needed to be separated
from the silicon.
