Why should she pay for McDonalds negligence?
The cup was defective, it failed, spilling the scalding hot contents on her.
If it happened to you you would have sued too.

I got a coke at Wendy's one time and the lid was not installed properly.
When I got a hold of it it collapsed on my lap.
I didn't put the coke in my lap but thats where the contents landed.
I didn't sue of course, but if it was scalding hot coffee that injured me I 
probably would have.
