Would you care to suggest what legal test you refer to here?  Nothing I
know about trademark law would prohibit its operation in this environment.

Trademark law prohibits the use of trademarks by other parties in a way
that might confuse the public or which might attempt to unfairly capitalize
on the good will or reputation associated with a mark.  There is no
"except when it comes to newsgroups."
