The accord, to be offered today in Geneva talks as a legal statement
amending the 1972 Anti-Ballistic Missile Treaty, aims at clarifying
missile defenses permitted under the treaty:
+ Ballistic target missiles, against which theater missile defense [TMD]
systems are tested, will have a maximum range of no more than 3,500
kilometers and a maximum flight velocity of no more than 5 kilometers per
second.
+ All TMD systems with a demonstrated interceptor velocity of 3
kilometers per second or less and tested as above, are compliant with the
ABM Treaty.
+ The sides will implement, on a reciprocal basis, the following
confidence-building measures regarding TMD systems and components to be
agreed upon by the sides:
1 - Advance notification of launches of TMD interceptor missiles
involving a ballistic missile target missile, including a test date
launch window and test location.
2 - Visits for the purpose of observing TMD tests.
3 - The exchange of information on TMD systems, components and programs,
including information regarding: programmatic status and schedules;
descriptions of systems and component characteristics and capabilities;
descriptions of operating concepts for TMD systems, including those being
developed or deployed;and, general descriptions of the numbers of each
type of TMD system being developed or deployed.
4 - Notification of all garrison areas for TMD systems within its
national territory, including homeport locations for naval TMD and
garrison military installations for other TMD.
5 - Annual notification of routine deployment areas for TMD systems,
including areas outside the national territory.
6 - Assurances by each side that it will not deploy TMD systems in
numbers and locations that could pose a realistic threat to the strategic
nuclear force of another side.
7 - Provision by each side of an annual assessment of perceived theater
ballistic missile threats and description of how the scale of its TMD
deployment is consistent with such threats.
8 - Consultation if a side expresses a security concern regarding unusual
military activities of another side regarding its TMD systems, with a
view to resolving any concern related thereto.
