I saw a bum/wino choking or thrashing or rolling around near the river today, as I crossed over that sludgy creek. I briefly thought about helping, then recalled that tort law says I have no obligation to stop, but that if I do, I have an obligation to help. I watched for a while, then decided he was fulfilling Darwinian law. So I passed this piece of shit by. Anyone hear about a death along the San Lorenzo this afternoon, Wednesday, the 12th? --Tim May

You may have been mistaken. That could have been anything from a suicidal kayaker to a bum taking his annual bath. To the best of my limited knowledge, both activities are still legal. >I briefly thought about helping, then recalled that tort law says I >have no obligation to stop, but that if I do, I have an obligation to >help. True. You also have a moral obligation to help or at least call for help. However, your apparently lack of any morals makes that somewhat difficult. If you are unwilling or unable to personally assist, perhaps punching 911 on your cell phone might have helped. >I watched for a while, then decided he was fulfilling Darwinian law. >So I passed this piece of shit by. A wise move. Your reputation among the homeless community is probably well established by now. Should you have disclosed your identity, most bums, Jews, minorities, blacks, gang members, politicians, and other undesireables would have suspected that you were trying to exterminate them, rather than offer assistance, and run for their lives. >Anyone hear about a death along the San Lorenzo this afternoon, >Wednesday, the 12th? My palatial office is next to the river near the entrance of the former Camp Paradise. Sorry, no recently deceased bodies are available for whatever experiments you wish to perform. However, should one become available, I'll let you know. Which spare body parts to you need to have intact and where would you like it delivered? -- Jeff Liebermann jeffl@comix.santa-cruz.ca.us 150 Felker St #D http://www.LearnByDestroying.com Santa Cruz CA 95060 AE6KS 831-336-2558

The only time you are obligated to do anything BY LAW is if you are "on duty." Since what's his face could not be on duty, he could go over and look at the guy and do nothing. If I am not on duty, I have no obligation to render aid, even as a state certified EMT. Also, if you try to do something, and even if you do it wrong (and weren't grossly negligent) you cannot be successfully sued due to the Good Samaritan Laws that exist is every state. I don't think you can be charged with abandonment if you at least notify someone. However, I am not a lawyer so don't take this as legal advice. > > >I watched for a while, then decided he was fulfilling Darwinian law. > >So I passed this piece of shit by. I couldn't do that. Well, in the sixties when the times were peacful, dig that, we had a bonfire down on the beach. that let it know beach whales couldn't land. It is probably a Hawaiian tradition, but don't see many landlubbers on the beach there probably.
