ASA IN THE NEWS: San Francisco Enacts Rules
The process looked to take weeks more, as Supervisor Mirkarimi’s OpEd
makes clear, but in the end Supervisors acted quickly to pass the
medical cannabis regulations he proposed. ASA worked with the city to
protect the thousands of patients who rely on San Francisco dispensaries
for the medicine their doctors’ recommend.
San Francisco adopts rules to regulate pot clubs

<http://www.insidebayarea.com/dailyreview/localnews/ci_3222138>
San Francisco supervisors voted unanimously Tuesday to adopt regulations
governing medical marijuana clubs after allegations of abuse at several
of the city's 35 facilities. Kris Hermes, legal director for the medical
marijuana advocacy group Americans for Safe Access, said after the vote
that most patients and dispensary owners were generally pleased with San
Francisco's regulations and regard them as a stamp of approval from the
city.

In a surprising change of heart, the Board of Supervisors this evening
amended and unanimously passed San Francisco's first set of medical
marijuana regulations, allowing nearly all of the city's 30-plus clubs
to remain open instead of closing or relocating more than a dozen, as
initially considered.

Medical pot, done right <http://safeaccessnow.org/article.php?id=2837>
by Ross Mirkarimi (OpEd), San Francisco Bay Guardian
<http://www.sfbg.com/40/07/x_oped.html>
Over the next few weeks, the San Francisco Board of Supervisors will
vote on whether to pass legislation I authored to regulate medical
cannabis dispensaries in a manner that puts the interests of patients
first, balances the concerns of neighborhoods, and moves us beyond the
indifference and neglect that put the clubs at risk of intervention by
federal authorities.

CALIFORNIA: More Local Regulation
San Francisco took a step toward resolving the matter of local
regulation of dispensaries, but many cities are attempting to dodge
their responsibilities, regardless of the consequences. San Diego made
news last week by openly defying state law. Others have taken a delaying
tactic or approved partial measures. Yet the will of the people and the
intent of the legislature is clear: safe access for those who benefit
from medical cannabis.

MICHIGAN: Officials Defy Voters
The people can speak, but sometimes officials aren’t listening. Two
cities in Michigan just approved measures designed to protect medical
cannabis patients from arrest and prosecution, yet in the case of
Traverse City, law enforcement officials are saying they will neither
cease nor desist, due to conflicts with state law. This highlights the
need for state legislators to heed public opinion and amend state
prohibitions on medical use.
Officials say pot's still a priority
<http://safeaccessnow.org/article.php?id=2826>
by Vanessa McCray, Traverse City record-Eagle
<http://www.record-eagle.com/2005/nov/17pott.htm>
Sixty-three percent of the voters in the last city election think
medical marijuana use should be Traverse City's "lowest law enforcement
priority," but no one should light up soon.

CALIFORNIA: Patient-Grower Convicted
What’s odd about this case, beyond the fact that it involves the
prosecution of a legal medical cannabis patient, is that the conviction
appears to have hinged on the judge instructing the jury that patients
can legally grow no more than the number of plants set by SB420, even
though it’s clear those are minimum numbers, not maximums, and precedent
says patients are entitled to whatever is reasonable for medical need.

trial ended Monday with a man being convicted of possession of marijuana
for sale, marijuana cultivation and possession of more than 28.5 grams
of the drug.

CANADA: Hospital Problem for Patient
While Canada has been doing better with the issue of medical cannabis
than the United States for some time now, patients still encounter
problems there. In this case, a patient certified by Health Canada for
medical cannabis use is being prevented from using it in the hospital.
Alternative delivery methods may make more sense in cases like this.

OREGON: Employment Rights an Issue
Employers in Oregon are on notice that they must exercise care in
dealing with their employees who legally use medical cannabis. While
federal law does not protect the rights of patients, state law there
may. A case coming before the Oregon Supreme Court should clarify the
matter.
Businesses face ‘gray area’ in marijuana law
<http://safeaccessnow.org/article.php?id=2829>
by Alex Paul, Corvalis Gazette-Times
<http://www.gazettetimes.com/articles/2005/11/17/news/community/thuloc03.txt>
When Oregonians approved the medical marijuana act in 1998, few people
believed that less than a decade later, nearly 12,000 people would be
allowed to legally grow and use the drug that is still considered
illegal by the federal government.
