FEDERAL: Patients Resist Raids on San Francisco Dispensary
Little more than a week after federal agents raided 13 medical cannabis
dispensaries in San Diego, the DEA descended on Hope Net, an exemplary
dispensary that distributes free medicine to indigent patients and has
been working with city officials on developing regulations. More than
100 patients and activists, including many from ASA, took to the street
in the rain and turned back the agents after a lengthy standoff. But the
DEA returned hours later and ransacked the dispensary, as well as the
home of the proprietors.

FEDERAL: State Judge Collaborating with Feds in San Diego
In yet another disturbing example of a renegade official refusing to
obey either the spirit or the letter of state law, it was revealed this
week that the judge who signed the DEA’s warrant for the 13 raids was a
state judge, sworn to uphold California’s legal protections for
patients. Jurisdictional problems may render the raids moot, as no
evidence from bad warrants can be used in court.

The warrants federal drug agents relied on to search 13 medical
marijuana dispensaries last week were signed by a San Diego County
Superior Court judge, not a judge from U.S. District Court.

CALIFORNIA: ID Card Program
The state legislature established the voluntary ID card system as a way
of protecting patients from the hassle and hardship of arrest and
seizure. It also saves taxpayers money and frees law enforcement from
wasting time on processing legal patients. Not all counties are yet
seeing the wisdom of such an approach, and questions remain about
preserving patient privacy, but it’s a step toward normalizing relations.

CHP: Rogue Commander Refuses Return of Medicine
ASA prevailed on the California Highway Patrol to revise its policies on
seizure and return of medical cannabis, but not all officers seem to
have gotten the memo. In this case, a commander claims he would violate
federal law by returning medical marijuana, even though numerous courts
have affirmed that a provision in the Controlled Substances Act makes
officers immune in such circumstances.

county's public defender demanded a court hearing to determine whether
the local California Highway Patrol commander broke the law by refusing

OP/ED: Protect Kids - Stop the Propaganda
Much of the propaganda used against medical cannabis concerns the threat
that it might pose to children. This patient’s view that the truth is
the best antidote has been proven out by research.
Kids should not use tobacco, pot or alcohol!

As a federal medical marijuana license holder, I resent the fact that
the media continues the propaganda and misinformation about marijuana.
This will make things even more confusing for teens. Why can't anyone
just tell the truth when it comes to pot?

FEDERAL: New Questions in Epis Case
Brian Epis, who had been a medical marijuana patient and provider in
Chico, has long maintained that his conviction and sentence was based on
a willful distortion of the evidence, and his appellate attorney says
she has evidence now of prosecutorial misconduct. Epis is awaiting
resentencing under new guidelines.

<http://safeaccessnow.org/article.php?id=2947>
by Fred Gardner, Counter Punch
<http://www.counterpunch.org/gardner12172005.html>
The judge who sentenced Bryan Epis to 10 years in federal prison now
realizes that Epis was the victim of prosecutorial misconduct, according
to Brenda Grantland, the lawyer handling Epis's appeal. Epis, 38, was
convicted in 2002 of conspiracy to cultivate more than 1,000 cannabis
plants. He was granted bail in August 2004, after serving more than 25
months. The government is intent on sending him back to prison.
