It is something that should never have to be legislated. Combine
courtesy and common sense and you get a situation where if traffic is
light to middling, the left lane is used as a passing lane. As
traffic densities get heavier and speeds get slower, the lane becomes
just another lane.
To put it into law invokes the law of unintended consequences, as the
original legislators likely never intended it to apply to rush hour or
other stop and go situations.
