I could only get 31.2 to Netcom but 33.6 to Demon, when I upgraded I was averaging 48000 to Netcom but only 46667 to Demon using the same telcos. Using a different telco I'm averaging 49333 to Demon. The protocols seem to use the line very differently, my line fades out towards the top end and this seems to have much less effect on V90. OTOH here in the UK (this is crossposted a lot!) BT (one of the telcos) uses a gadget known as a DACS which allows two phone "lines" over one copper pair and this usually limits connection speed to 26.4 or so. Does your telco do this? It's still all a bit of a crapshoot, there are one or two Rockwell chip modems which don't like negotiating with (Rockwell chip) Ascends, for example, when mine did that half the time it would only pull 21.6, but it works fine with 3Coms, go figure. It's going to take firmware upgrades on both your and the ISPs' end probably before all the other problems are ironed out and you can be *certain* that any failures are down to the quality of the wet string your telcos use, in the case of the original poster, and Dave, it looks at the moment very much like a line quality problem, different modems are getting slightly more or less performance out of it but the potential just ain't there. :(
