It is my understanding that the artist or originator of artwork does not
have to apply for a copyright but owns it as the creator by default under
Canadian copyright law. Rule one in creative and advertising is always
cover your ass. To do this you should have a contract, which outlines
your copywrite and is signed and acknowledged by your client whether
payment is recieved or not. This just clarifies your aggereement and
avoids misunderstandings in the future. Whether you have a contract or
not under Canadian law the originator of the artwork owns the copyright
unless otherwise agreed in writing. This is my understanding. Hope this
helps, If you have any questions feel free to drop me a note.
