You don't need either. BUT you need a signed contract. I'm on shoots
for the next couple of days and will forward the info to you as soon
as I get a moment.

I've done a few custom contracts for CD covers but be warned;

The music industry is organised crime. Photo pricing software such as
Photoquote even has a special section warning of the shit that record
companies pull.
