Anywhere at anytime or just in specific instances?  And if the 5 mph
tolerance is going to be used for the slow driver would it not be fair
to also apply this to the fast driver?

In principle I agree with this however if the policy's intent is to
legislate a law so others can break the law then we've gone too far.
Driving unecessarily slow is one thing, driving too slow to suit the
fast driver is another.  It's a mistake to confuse the two.
