Someone ELSE signed my name on a delivery!! What can I do? **

I just ordered something that was VERY important for me to get ASAP through the mail, and had it delivered by FedEx. The problem is, (so far) it seems as though it was delivered to a different (yet similar) address... I'm in apartment H while it was delivered to apartment A since the company seemes to have mistakenly heard me (and put A on the label) But *SOMEONE* (I'm assuming it's that person at apartment A) *SIGNED* my name, upon delivery!! The person at FedEx said that that's ILLEGAL. What can I do? (with our wonderful legal system and such) I'm EXTREMELY ticked off not only because he/she "took" the package, but more so because that person SIGNED MY NAME!! I just hope that that person didn't open and *USE* the package (obviously knowing, after opening up the package, that it was a mistake).. -taka

Well, have you tried 1) simply going over, knocking on the door at apartment A, and politely explaining that a package addressed to you had mistakenly been delivered to them, and you appreciate them signing for it, but could you please have it now? If that doesn't work, you might try going through the apartment management. And if you still can't get your package (intact), ask FedEx about your legal recourse - obviously they have dealt with the situation before. You will probably have to get the sender involved. And if you paid for whatever this was with a credit card, I feel reasonably sure that you can dispute the charge and insist that the vendor send you a new whatever-it-was and take it upon themselves to retrieve the package, as they made the mistake in addressing it. i've tried to go several times, but no one's there... i agree, though, that
that is the first step... but It wouldn't have been a big deal if:
1. The person accepted the package, knowing that he/she is usually around
and was willing to take on the responsibility of getting it to me ASAP
considering it came FedEx. I've been home all day today, and I'm always
home in the evening. I don't even have a note on my door from them.
2. He/She noticed (and he/she SHOULD have) that there *IS* a "Torimoto"
in the complex/building, considering that the aapproximately
2' X 2'-sized mailboxes are less than 2 feet to the left of their door,
and that *MY* mail box is the ONLY one with my last name and apartment
number on it (because I was the only one who bothered to label it). My
label also obviously stands out on the box...
3. If the package wasn't important. But considering it was delivered FedEx,
and was first deliverd on Wednesday, then tried on Thursday, (with the
residents not being home both days) and then finally
receiving it on Friday, just *MAYBE* they could have thought it was
important? By that time, 3 days later, don't ya think they COULD have
checked the mailboxes to see if there was a Torimoto (which was probably
on the FedEx "it was delivered" paper on their doorknob?)?

I might do that...

FedEx is already looking into it. I also found out that the package only had
3329 and no apartment letter (which could be anything from A to H, with my
apartment being H), but the FedEx guy (consistently) tried to deliver to A
for some unknown reason.. you'd think that the FedEx guy, after 3 days, would
check with the leasing office (or look at the mailboxes) to see where
Torimoto lives, instead of assuming I live in apartment A... *shrug*
I'm going to stop by once more late tonight at A, and if he/she is not
there, or if he/she decided to open and use my package, then I'm going to have
to find some kind of prosecuting... at least for "forging" my name, *WHIC*,
by the way, they misspelled (they signed TOROMOTO instead of TORIMOTO.
How stupid.

FedEx, the credit card company, and the supplier of the package may need it, but if you need to take legal action it would be better the earlier you sent the letter. YMMV. > FedEx is already looking into it. You could also bring action against FedEx for thier stupidity, but IMHO your best bet is against the company sending you the product, or your forging neighbour. > to find some kind of prosecuting... at least for "forging" my name, *WHIC*, > by the way, they misspelled (they signed TOROMOTO instead of TORIMOTO. > How stupid. Well, bringing a suit up can be extremely expensive, but you can (slightly) more easily merely report a case a forgery to the police and have a warrent issued. You don't get paid, but you should get your package and a warm smug feeling. The threat of that could be effective, too. Most leases have a clause about criminal activity, too, so you can always have your landlord kick the jerk out. ;) -- \\\\\ Jimmy Brokaw gt6300c@prism.gatech.edu \\\\\\\__o Bringing hedgehogs to the common folk since 1994. __\\\\\\\'/________________________________________________________

i have had similar misadventures with dilevery. My roommate (whacky guy that he is) ordered a christmas tree and all the trimmings from macy's. (Like i said he's kind of whacky). He went a little over board and ended up making quite an investment in this tree and the decorations. Well after considerable stalling, they finally delivered it... somewhere else. they don't even know. Some random person signed for it and KEPT OUR CHRISTMAS TREE. Can you believe that? This loser stole a christmas tree. Moral of the story: never have things delivered, and never sign for and keep other people's packages! brent that guy (ccasttt@prism.gatech.edu) wrote: : I just ordered something that was VERY important for me to get ASAP through : the mail, and had it delivered by FedEx. : The problem is, (so far) it seems as though it was delivered to a different : (yet similar) address... Assuming you don't just go ask the person for the package, I believe that it's generally not your problem. Just like it's not your problem if it disappears during shipping. If your paid by Credit Card, then you can definitely do a charge back if the company won't cooperate. In any case, and check with the company, but I believe that the Company and/or FedEx have been defrauded, not you, and they are the ones that will take legal action. Keith Graham skg@sadr.com

They do things like that all the time (don't even require a signature). I paid $10 to get my brother's car title shipped to him over night, and they just left it on top of his mail box (they told me this) and he never got it. So now he has a car with a disputed title (harder to sell or trade in) because he had to request a replacement. The Post Office was unable to comprehend what was wrong with their service much less admit they did anything wrong. MORAL: don't use the Post Office for anything if you can help it. I used to work for an airline, and we used to ship mail for the USPS, and I was amazed at how much of it got lost when boxes opened and it went under conveyor belts and such. > I now refuse to use UPS for anything. Due to the lack of reliability of shipping important things, I have
a new ssytem that I developed.
I now map all of the atoms of what I want to send and send them
via a 'beam' (for lack of a better word) to the delivery location.
The tough part was the whole uncertainty thing, but I just built
a compensator for that, and now it is all better.

Gimme a break, they've been doing that on Star Trek for decades....

Depends on the shipping terms. If the terms are FOB Shipper's
Door, then title to the goods passes from seller to buyer at
the seller's dock (or mail room). If delivery company fails to
deliver the goods, the seller isn't legally responsible, the
delivery company is.
