Right again > I think this can be extended to any form of "intentional" > distraction that contributes to an accident. The gov't can't conclusively prove whether you spilled your Big Mac on your shirt, or if you were changing CD's in your stereo when you cause an accident One thing is for sure regarding cell phones: the gov't CAN determine if and when someone was on a cellphone, who he/she was talking to, and for how long, whenever they want. Probably in the name of national security. I don't agree with that philosphically. But after nearly being on the receiving end of cellphone-inspired poor driving several times myself, I believe that there should be accountability if the at-fault driver was shown to be talking on the phone when the accident occurred. At least make them pay if they f**k up because of their cell phone!!
