Perhaps I am wrong but I don't see what the problem is...as far as I know when
you are a PhD student, you are working on a project which is part of an
advisor's grant...if you did alot or work on it and that work is published in a
scientific paper, then you should get authorship...however, just because you
worked on it, doesn't mean he can never work on that project again. In fact,
I would imagine that if you left your PhD project and never finished it, so the
thesis was not deposited....that your old lab would continue working on that
project/topic..perhaps giving the work to a new student or PostDoc....and
getting new funding for it. In fact I think even if you had stayed and finished
the dissertation, the lab would continue to pursue the project after you went
on to PostDoc. I would say, based on what I understand from your description,
that this is common practice and very ethical and legal. I also don't
understand why you are "fit to be tied" other than you still have bad feelings
for the advisor...you left the project, and I would imagine in doing so gave up
any claim you might have, or any say in its funding or continuation.

Of course this is only my opinion,
Jen
