The federal government has no constitutional power to do so David. The
only reason they were able to do so was that the territory is not
covered in the constitution and the government has the power to override
any acts of the territories parliament.

But they can't make an act to ban it throughout Australia. It is legally
unable to do so under the Australian Constitution.
