The UN Declaration of Human Rights is not legally binding. It is only a "gentleman's agreement". The UN Declaration of Human Rights cannot override a countries constitution. The constitution states that the Federal Parliament cannot make laws in regards to the states to such a matter. They cannot override the law whatsoever if a State decided to make such a law. The High Court would laugh at such an argument as you have suggested.
