TENATNTS ! UNITE !
now that the harris "Tenants Protection Act"
has come into power (since 17 june 98)
and even before that
landlords are trying to raise the rents on the "stay put" tenants.
how ?
1- tightening the screws on tenants, like no storage in balconies
2- doing unnecessary repairs (that raises the rent 4%/year, + the
automatic 3%/year)
the landlord sends tenants a notice stating that the landlord
will enter the units to "inspect" the appliances
the landlord pretends to inspect the stoves and frigs ( a cursory
outside look"
the landlord sells "all" the appliances to a friend as "junk",
and pockets the proceeds, under the counter.
the landlord replaces the appliances with newer ones, of inferior
quality.
3- the landlord does unnecessary repairs to the balconies, etc
the landlord calls the unnecessary repairs
"capital repairs", a contradiction in terms.
the unnecessary repairs never end.
:loop
the landlord does some chipping (noise, dust, emptying the
balconies, in conveniencing the tenant)
the landlord covers the chipped places
the landlord jacks up the rent on the "stay put" tenants by 4%
goto loop
4- if the "stay put" tenant gets fed up (planned), he has to move out
to a new place. a new tenant is not protected by
harris' "Tenants Protection Act".
is lord harris a liar
does lord harris get landlord kickbacks/cuts
is lordharris a sadist
?
. landlords crackdown. heil harris !
TENATNTS ! UNITE !
is there life after harris ?

This situation is certainly going to create more homeless and panhandlers for the city to crack down on. Very good point. I actually had to move out from the house I was renting because of such (and more funnier tactics). However, this was a lucky break for me, I am in a better neighbourhood now, renting just a room instead of having to worry about having other tenants sharing the house. Of interest, here are some of the tactics used by my landlord; - putting a junk car in the hous parking - though of course he does not live there - claiming that the contract does not include renting the parking. - serving a note of evection on the second day of the month (he insists that pay should be made on the first day of the month, which is not practical as I also had to collect rent from my tenants, some of whom are on welfare). I believe he was trying to develop a profile of delayed payment, though I ultimately paid all rent for the past 4 years. - Refusing to make repairs badly needed to the house. So, in one of his bogus late payments claims, I did not pay, went to court with 2 films of every room and wall in the house. Of course he refused mediation, went in front of a judge, who ordered the repairs to be made and deducted $400 from the rent (which incidently I paid to court, which proved to take a long time to reach the landlord) Of course, repairs were done, but very unprofessionally, e.g. paint jobs, including changing the carpet of the first floor to the lowest grade of carpets available and the worst colour you can imagine. - Asking to do repeated inspections at times he knows that me and my tenants are asleep (we work nights) even after the repairs were finished (of course doing them during the times we were supposed to be asleep in first place). These inspections I have rejected. I have called the police once for him as he entered the house without my conscent, for such an 'inspection'. - Bringing people to view the house for rent, though I have not given notice. This was to create uncertainity among my housemates. - serving 3 consecutive rent 'increase' notices within one month, each cancelling the previous one and is of higher value. The last one stated that the rent will be increased by $150/month due to 'legal expenses'!! Ultimately, I left the house, who wants to live in constant problems? I discovered that I am not alone in this. In fact the judge mentioned that the number of evection cases has risen considerably (even before the law became enforced) just in anticipation of it. Where I work, I met a woman who was evicted by a court order that was obtained while she was out of the country (in February) and got evicted yesterday, without knowing even that a court order has been obtained. This has to do with the practice of accepting 'witnesses' that the formal papers were served to the tenant, instead of the more reliable registered mail. Of course the Sherriff does not listen, he has a court order (and of course many evection orders to enforce). She has to go to court!!! Yes, a lot has to be done to restore the human rights of tenants. Basically, I believe market forces will come into play and landlords will become realistic in their rent requirements and their treatment of tenants. However, I do not plan to wait for that to happen. I would do every thing I can to owning even a small apartment as a first time buyer within the coming three years. Until then, I hope that I can deal with landlords. -- Nabil M. El-Khodari. "Men use thought to justify their injustices, and speech to conceal their thoughts" Voltaire

tenants protection act

1- for sleepy tenants
just read on www that if a tenant does not re-sign his tenancy lease
then he will automatically become a month-to-month tenants
2- some landlords are contemplating framing/beating up tenants activists
3- the tpa has taken away many disputes that used to belong in court.
and put them in the hands of some tribunal
4- federation of metrotoronto tenants assns, has a hotline manned by
1 lawyer.
practically useless. overwhelmed.

There is no lawyer that I know of on their hotline, only a "paralegal" and that is with $96,000 in city funding for the phone line and one person to be on it 40 hours a week. Why are you looking for the text of the law? The way you've been critizing it one would almost believe you knew what you were talking about.... But I guess not. BTW, your item one about reverting to a month-by-month tenancy. That's not a change. Has been that way for years. ========================================== Al Aab wrote: > > any1 knows if there is a www copy of the so-called > tenants protection act > ? > > BTW > 1- for sleepy tenants > just read on www that if a tenant does not re-sign his tenancy lease > then he will automatically become a month-to-month tenants > > 2- some landlords are contemplating framing/beating up tenants activists > > 3- the tpa has taken away many disputes that used to belong in court. > and put them in the hands of some tribunal > > 4- federation of metrotoronto tenants assns, has a hotline manned by > 1 lawyer. > practically useless. overwhelmed. > > -- > =-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+-+- > al aab, seders moderator sed u soon > it is not zat we do not see the s o l u t i o n > -=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-=-+ -- Frans van Duinen (416) 588-0698, Fax (416) 588-9690 Master Programmer Group Inc. since landlords own the property and call the shots, my suspicion is that any trickery and harrisment is their doing. not sure though, see, I havent had a landlord in a considerable time, since shortly after the time I was apt hunting in st catharines and would enquire as to are there anyone who has given their notice and if so, I would be interested in taking that unit. just tell me, there must be someone in a building this size that has given notice. if not this month then next. etc etc. the response? well, seems if I was to hand over a months rent, that would get me on a special list. oh, so you want the first months rent up front? no, that is to just get on the 'waiting' list. ie a godam BRIBE. payola. pay 13 months rent for a 1 year lease. and THAT is typical landlord behaviour. gouge gouge gouge. The field has been uneven in favor of the tenants for so long and no landlord or investment would like to construct rental building because it is just not viable at all even when the TPA is passed. It is simply a matter of supply and demand - the costs of maintaining a privately owned rental building (including pleasing some tenants from hell) outweighed that of the return. Until the pendulum has swung to such an extent that a reasonable return (of about 3-5%) for those investment, there won't be any substantial infusion of capital (from private source) towards the construction of rental housing. Now that there have been no construction of public housing following the devolution , it is guaranteed that there won't be enough rental spaces in GTA. Rental will only be driven up until private investment fund come in building up more rental housing. I am afraid this long process takes over 5-6 years to take effect. Dan
