We suffered the same recently, and are still to hear from the Canadian
hosting and ISP firm.  Initially, they were apologetic, but despite numerous
emails they still haven't got back to me.

For us, we neither have the time or money to fight a law suit - even if one
was valid.  Thankfully, the bastards - www.maxiannounce.com - aren't much
competition, being a French-Canadian site, and in any case, my code is still
on my server so..
