He killed. intent or not, the result is the same. Nobody forced him to drink
and he knew he shouldn`t drink and drive, Everybody does.

I believe that by drinking and driving the intent to murder is there, just
by the fact that you have been drinking and know you shouldn`t be driving,
Drinking is a willful act, and so is driving afterwards.

And in case you think I don`t drink ,wrong ,I do , but I don`t take one
drink and drive, not because of the penalty involved but because I may hurt
an innocent person.

And in Ontario if you have an accident after even one drink, you are
automatically at fault even though the limit is .08....., the same if you
have taken legal drugs which can be classed as impaired driving.The onus is
on you to prove you weren`t impaired

However unfortunately here in Ontario the penalty I have seen for murdering
someone while "impaired" can be as low as two hundred dollars and a three
month driving suspension.

At least in the States they have some teeth in their laws.
