The problem with this (warning: personal, unproffesional opinion
ahead) is that switching lanes can cause more of a hazzard then
staying in the 'faster' lane with someone on your tail.  In order
to move over, you're going to have to find a window of opportunity
to slide in (which can be a major pain in busy traffic, especially
when you are traveling faster then the other lane to begin with)
And there's always the possibility of someone that is in your
blind spot when you switch lanes.  You're also gonna piss off
the people in the slow lane by cutting off the space that is
in front/behind them.

I live right off the San Tomas Expressway section near El Camino,
where it narrows from 4 lanes to 3 lanes, and I've taken to
'breaking the law' and driving in the commuter lane for 
two lights because of similar problems.  I've almost been hit
or hit people too many times trying to jump to the exit/comute
lane right at my turn off.

And speaking of which:  Does anyone know exactly how long
you can drive in a commuter lane where it's on the outside
of the street without worrying about a ticket?
