Passing on the right is not a traffic offense in California, except if
there is only one lane of traffic in your direction, and even then there
are exceptions that let you pass on the right.

The left lane in California is simply for driving, as is every other
lane.  No lane is reserved for any specific purpose, except possibly for
carpoos when specially marked.  Slow-moving traffic is supposed to keep
to the right, but you don't have to be passing to be in the left lane.
In fact during rush hour when the highways are congested, hardly anybody
is passing anybody else to any noticeable extent.
