Make your pledge: Fund to sue TFN Board

This is for the few of you that believe that the current board is not
doing what it should, or what it takes to REALLY save the TFN. It is also
for those who believe that the TFN will come out intact from it is
current crisis (which I believe is denial) through (in my terms in spite
of) current board actions (in my terms inaction).

For those two groups, I suggest that we start a fund right now to sue
them in the unlikely (for me the sure) event that the TFN would dissolve
and the TFCN (Bruce, McGregor, Dmytri, et al.) would end up inheriting it.

The board is LIABLE, irrespective of the bylaws...

The board is certainly not seeking to achieve the passed motions in that
last AGM (GUI, IRC) by the membership, something that may eventually save
the TFN through a greater user support.

The board believes it can do what it wants, not what we elected them to
do. Let us show them that we mean business if they do not get their
collective asses together and do really something instead of the lip
service we have been receiving.

I would appreciate that someone else be actually responsible for such a
fund. Please show your support by following up to this thread stating the
amount of money you pledge to such an effort. You will be contacted to
provide other data (telephone number, address, etc.) so as we can be
prepared whenever is it the time when we shall wake up and the TFN is gone.

Ahh, you summed it up in your very first sentance, Nabster. "This is for the
FEW of you..."

Always the minority causing trouble and rucus for the majority.

Out of curiosity, Nabil, how much are you contributing to this fund?

Note: You, as a former director, are liable for 2 years after the termination
of your tenure, whether it was a voluntary termination or not. Interesting that
you are proposing to sue yourself...

Hmmm, the $$$ which the fund is soliciting for would
take money away from the TFN's efforts to sustain itself...
I certainly am not impressed with his sincerity when he
speaks of "REALLY saving" the TFN (unless he means in
	his bank account 8^)

My contribution to the fund? I hereby give warning
that it's been our experience that Nabil is a
charlatan (in case anyone wasn't aware of that 8^).
Please consult the TFN Usenet archives in case
there is any question in your mind on the subject...

Well, believe it or not, I did not help in any way in digging that pit.
That is why I was removed first of all. Only those 'in power' can do that.

Believe me when I say I would rather be proven paranoid and demented than
proven right. That is why I am exerting pressure on the board right now
and will continue to do so.

If I merely wanted "I told you so" thing I would have better shut up and
let things move in the wrong way.

So, if you are so sure of yourself - or at least sure that I am deadly
wrong - what is the harm in challenging me and pledging whatever you can
just in case (please make sure to mention your viewpoint about me along
with your pledge).

Thank you. Sincerely,

They have done absolutely nothing, contrary to what they say and think.
They have passed a lot of motions that they have not yet followed up with
(eg. IRC, etc)

They don't follow the bylaws.

Sorry, I just said that :D

Do? The board does nothing, as previously mentioned. The board should do
the right thing, and call a new AGM. Perhaps then, new board members
would be elected who would actually get things done, instead of sitting on
their collective asses.

Hmmmm. This is a good question. You mention about the TFCN
"inheriting" the remains or such of the TFN. My question is how will
they inherit the remains and such of the TFN and is there anything stated
or listed in the bylaws to deal with when the TFN becomes bankrupt???
Maybe they would sell off their assets and donate the money to a charity
or something??? Hmmm. Maybe that's something to check on. :) Of
course, the sale of assets should be done by an independent organization. :)

Hmmmm. Ok. You mention the GUI and IRC. Well, the GUI, although
nice, is really a luxury item, right? As for the IRC, well, it too can
be considered a luxury item as well. Yes the IRC has been used with some
meetings I've heard or such and if it is available, it should be usable
by the general population here.
Though one thing you have to remember here. Anybody could have made a
suggestion to be voted on during the last AGM, right? If so, who says
that even if a suggest was made, it was a good suggest. You have to
think realistically. Just cause something sounds nice doesn't mean it
can be practical.

It is no threat, merely a fact all of us have to live with - the fact
that we are all liable up to two years after leaving the board. It is
stated very clearly in the Ontario Incorporations act, something we
hall had the duty to familiarize ourselves with before accepting the
post with the TFN.

As for "sending it by email", you demonstrate your ignorance of the
Internet again. The original message was posted to tor.general and
any other groups you originally had in your header. It was CC'ed to
your email by default, as you have your newsreader set to "CC By

Ah, no. Again you demonstrate your ignorance. I will not even delve
into what we have done over the last year since you steadfastly
refuse to admit anything but your own delusional imagings. The fact,
however, that when we were all elected the TFN was due to go belly up
in January, and we are still around today, should poitn out your
fallibilities quite clearly.

This response is in email only, in order to save you ambarrassment
from your ignorance. If, however, when I check the groups in about an
hour, I find you have posted this traditionally inaccurate and
paranoidal letter to the groups, this reply will be forwarded there
in it's entirety.

Hi William:

I am at no position to discuss either the bylaws, or the motions that
passed. This is not a discussion of the merits of GUI - with its value to
both users and advertisers. The motion to apply GUI was passed in a legal
AGM, and as such should have been implemented by the board who is
selected by the membership to do what the membership - not to mention
many other FreeNets - have done long ago.

The fact is the current board is legally responsible and can be held
accountable.

You will see a lot of garbage thrown on me and a lot of lip service of
what WILL be done and what have been done (all are very flimsy gains and
I beleive they knew it from the start)....

They would keep the TFN the Dinosaur it has been (not to mention cutting
a limb here and there in the name of security).

Sincerely,

Nabil

You need to attend a board meeting or two in order
to have a a realistic basis with which to pass
judgement. Please note that the board and most
of the TFN are volunteers - things don't get done
mostly because there is far more to do than there
are volunteers to do them. If you don't like
something, the best way to try to fix it is to
get involved & put your own best effort into it
(otherwise you are subject to the criticism that
you are taking potshots while sitting on your
	own collective ass 8^)...

Dear Joao:

I do not want attention. I prefer to have the TFN working. As for
positive or negative attention as you put it, in my vocabulary they are
advocacy. You seem not to have dealt with an activist before, nor does
the current board. Rest assured that I am not looking for an 'opening' as
you put it.

However, just for your info. I have volunteered to work at the office -
even after my removal - and actually renewed my pledge to do so, after
being informed that Geoffrey Gies can no longer volunteer.

So please Joaoa, do whatever you want to do, whether positive or
negative, I do not care.

Now to put every one at ease, I - though informed that at least 8
positions were be opened for elections - clearly made my point that I am
not going to appoint myself. I would prefer to keep my privileges as an
ordinary user, with a healthy interest - as opposed to apathy - in what
goes on.

Only time would tell..

Sincerely,

Nabil

Joao;

Your summary of Nabil is accurate to the last point. Many of us have tried of
the last year to get him to see where his faults in logic lay, or even the
simple nastiness of his disposition. Alas, as a truly disturbed person, he
refuses to act for the greater good, but merely for his own attention.

If you want a chuckle, check out my little project on him at

Jae, according to our membership database, you are not a TFN member. So
why are you so critical of TFN? Why on earth would you care?

That should make no difference. I have a few good friends in Toronto,
hence my concern.

This was hilarious, of course we miss Sue. As for your money, sure it is
needed if the TFN is to survive. Whether you chose to contribute to
Bruce-sustainability fund, or to pledge it in case the test of time
proves what the current board is actually accelerating the demise of TFN,
is entirely up to you.

Of course, if a lawyer donates his services, and I am contacting one,
there may be no need even to pledge any money except those needed to file
the suite.

Again it is up to you and what value you attach to TFN services (or more
appropriately would be services) to the users and the community.

Thanks for the laugh.

Uhh, Sue is no longer on the Board. Helllooo - reality check! She's been
gone for over a year. Hello? And even if she were, charmingly lady that
she was indeed, would I give her money?

All they want is my money.

Geeze, you guys make a Monty Python skit look dull (splinter!!
splinter!!)

Let me see if I have this correct: a group of people, not satisfied
with how TFN is being run, start their own little junior boys club.
This club itself destructs soon after. Now, certain former member(s)
of the group want to sue the TFN board, even though one of them would
actually be suing himself....

That's pretty much the size of it :)

Hmmm, Nabil's Flying Circus... Sorta has a ring to it, doesn't it?

Well, I shall take my chances in front of a judge. I actually would be
very happy to do so. Only then would we expect the truth or something
very near to it. If you find that amusing, I find it the ultimate degree
of responsibility and actually being confident in whatever actions that I
have made during my very short period as a TFN board member.

Though I am, for all what matters, no longer in a position of
responsibility, yet I am sure that the TFN membership knows that I have
not turned down their trust or the privileged votes that I have gained.

Just for a clarification, I hope that the pledges would not be called, as
I hope that the mere idea of a suing the board would force the board to
take the necessary actions to do their best - instead of .... - to save
the TFN or actually submit their resignation as a group before the next
nearby elections.

Sincerely,

Nabil

Dear Marc:

I believe it is outrageous to suggest that someone who does mistakes, is
all the time mistaken. It is obvious that only dead - or functionally
dead - people (and angles) are the onl;y ones that do not do mistakes.

Add to that the fact that any mistake I have made, I was responsible
enough to apologize for... theory', only the current board can prove me
wrong.

I am still defying you - or any board member for that matter - to publish
a comaparative table between the 'performance criteria' posted elsewhere
between the current board (supposed to be functioning) and the previous
board (that we all know was a dysfunctioning one, thank To McGregor role
and the Allisat Affair). Please do not compare through number of users,
which we all know is balooney).

Such objective comparison is the only valid response that will not only
shut me up, but also is the thing that would be a correct response to the
media.

The media - and I hope the membership - have had enough speaches,
opinions, etc.

It is seems this is coming at an appropraite time for the board, which
should be busy preparing its financial statement for the coming AGM... Or
shall we expect no financial statement????

Sincerely,

Nabil

Nabil, in the past two years, I have spent so much time in posting facts and
figures to prove you wrong that doing your bidding is simply pointless. If you
want to kill the TFN so badly, go ahead, mister, give it your best shot. You.
