Hello, my apologies for posting this to this group. I couldn't think of another group who would understand and have experience with copyright laws w.r.t. artwork. I am submitting a photograph to a group. They are going to include my image in their CD cover. I don't know what to write w.r.t. to copyright or contract. Must I get this signed, witnessed and stamped by a lawyer? As a poor artist, I can't afford a lawyer. Will a notary do? Can someone direct me in the right direction? ASAP? Thankyou.

It is my understanding that the artist or originator of artwork does not have to apply for a copyright but owns it as the creator by default under Canadian copyright law. Rule one in creative and advertising is always cover your ass. To do this you should have a contract, which outlines your copywrite and is signed and acknowledged by your client whether payment is recieved or not. This just clarifies your aggereement and avoids misunderstandings in the future. Whether you have a contract or not under Canadian law the originator of the artwork owns the copyright unless otherwise agreed in writing. This is my understanding. Hope this helps, If you have any questions feel free to drop me a note. aaron Case wrote: > Hello, my apologies for posting this to this group. Say, did you hear what happened when Mandy Williams submitted her photo to Spirit of the West for their CD "Faithlift"? >Must I get this signed, witnessed and stamped >by a lawyer? I'm on shoots for the next couple of days and will forward the info to you as soon as I get a moment. >Can someone direct me in the right direction? ASAP? "Canadian Copyright Law" by Leslie Ellen Harris. And get Tad Crawford's "Business and Legal Forms for Photographers" immediately. I've done a few custom contracts for CD covers but be warned; The music industry is organised crime. Photo pricing software such as Photoquote even has a special section warning of the shit that record companies pull.
